Incident Appeal for Lap 39 Incident - Joe DiSpirito


This is my appeal to the incident that happened on lap 39.


As the #43 truck and I are entering the trioval, you can already notice that the #43 truck is already crowding down on me from the third lane. I am currently in the second/middle lane.


When driving in the second lane on the track, exiting the tri-oval, drivers naturally progress over the lowest dotted line to stay in the second lane.


You can see the cars in front of me naturally doing this motion and getting ready to enter turn 1 in the second lane. I have already made that natural move fully as the #43 truck decides to suddenly turn down into me.


I make no sudden turns or moves, but it is very obvious that the #43 truck jerks his car left and right rear hooks me.


#43 immediately apologizes because it was fairly obvious. He states “Sorry, I thought I had more room.”


I should not be receiving a penalty for this incident. It was very clearly the #43 truck turning into me while exiting the tri-oval.
